What Is 38 CFR and Why Does It Matter?
38 CFR (Code of Federal Regulations, Title 38) is the set of rules the Department of Veterans Affairs uses when evaluating disability claims. It defines how conditions are rated, what evidence the VA looks for, and how symptoms are classified by severity.
When a VA rater reviews your claim, they compare your reported symptoms and medical evidence against the criteria in 38 CFR. If your claim language doesn't align with those criteria, it can result in a lower rating or a denial — even when you have a legitimate condition.
